I found this chimney pipe on an inspection yesterday. The client (who was the seller) was shocked that the city inspector would miss something like this & the fact that the client is a general contractor & he missed it, was even more surprising to them. The biggets question about this issue was, Is this covered by the builders warranty? (two year old house). I did recommend complete evaluation of both fireplaces (they had not been used). Does anyone know if this would be covered by the builders warranty? I told them that this is a huge liability issue & I would ask if anyone knows about warranty coverage.

Tim, doesn't Calif. have a 10 yr. construction defect law? If so, the installer could be required to correct this.
Can you provide the make & model?
If this was shot from below, where is the damper?

A full Level II at least is warranted here and possible a Level III. Shocked

I know the place I got my DIY liner from, Chimney Liner Depot, has a lifetime warranty. I would definitely look into that law though.
